GREEN MOUNTAIN ENERGY ACP GIFT CARD SWEEPSTAKES – OFFICIAL RULES
The Green Mountain Energy ACP Gift Card Sweepstakes (the “Sweepstakes”) is open to legal residents of the State of Texas (except where prohibited by law), who are at least 18 years of age at the time of entry. Residents of any other jurisdiction are not eligible to enter. See additional eligibility requirements below in the Section entitled “Eligibility.”
- THE SWEEPSTAKES:
These official rules (the “Official Rules”) shall govern the Sweepstakes. The Sweepstakes in connection with the prizes (one (1) $100 VISA gift card from begins at 4:00 PM Central Time (“CT”) on August 21, 2018, and ends September 25, 2018 at 9:00 PM CT (the “Sweepstakes Period”). The Sweepstakes is sponsored by Green Mountain Energy Company, 1303 San Antonio Street, Suite 700, Austin, TX 78701 (“Sponsor”). By entering, you understand that you are providing your information to the Sponsor. The information you provide as detailed below will only be used for promotion purposes.
- TO ENTER:
By entering the Sweepstakes, the entrant agrees to be bound by the terms of these Official Rules. Sponsor is not responsible for late, incomplete, void, corrupted, misdirected, or otherwise erroneous entries or for any problems, malfunctions or technical difficulties that arise in the entry process. Any incomplete or incorrect entries will be void. Proof of submission will not be deemed to be proof of receipt by Sponsor. Once submitted, all entries shall be the property of Sponsor and will not be returned. All entries submitted in compliance with these Official Rules and not disqualified are considered “eligible entries.” You are entered by completing the survey and entering your contact information at the end of the survey.
You must complete the survey and submit your contact informationin the form at the end of the survey by 9:00 PM CT during the Sweepstakes Period.
- DRAWING:
Upon completion of the online survey, customers will enter their contact information in the online form provided. All survey submissions with contact information will be considered eligible entries for the random drawing to be held at the end of the Sweepstakes Period.
At the end of the Sweepstakes Period, one (1) prize winner will be selected at random by Sponsor from among all eligible entries received by the entry deadline. The winner will be notified via email. An alternate winner(s) may be randomly selected by Sponsor from among the remaining eligible entries if the selected winner(s): (i) does not respond to the email announcing they are the winner within XX days; (ii) fails to execute the release required by these Official Rules; (iii) dos not comply with any other rule or condition of the Sweepstakes; or (iv) cannot accept or receive the prize for any reason.
The decisions of Sponsor, including the selection of the winners, are final and binding on all matters relating to this Sweepstakes. Odds of winning depend on the total number of eligible entries received during the Sweepstakes Period.
- PRIZES:
At approximately 9:00 PM CT on October 1, 2018, one (1) potential winner will be chosen in a random drawing, from among all eligible entries received during the Sweepstakes Period, to receive one (1) $100 VISA gift card
An eligible entrant who is chosen as the winner of any one (1) prize is ineligible to win any further, additional prizes.
The potential winners will be notified by Sponsor in the following way:
Sponsor will email the winner within 5 days after the end of the Sweepstakes Period.
The total approximate retail value of the prize to be awarded in the Sweepstakes is $100. A prize may not be substituted or transferred by a winner. Exact prize details will be determined in the sole discretion of Sponsor. Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value. All additional expenses incurred by a winner in accepting and exercising a prize will NOT be provided by the Sponsor.
Each winner will be required to complete an affidavit of eligibility/liability release prior to receiving a prize. The affidavit and instructions for returning the affidavit will be provided by Sponsor when the winner is notified. The winner must return the completed affidavit to the Sponsor within twenty-four (24) hours of notification of their winner status. Failure to return the affidavit will result in forfeiture of the prize by winner.
Each winner will be responsible for all federal, state and local taxes and surcharges related to winning a prize; Form 1099 documentation will be issued as required by law.
- ELIGIBILITY:
The Sweepstakes is open to legal residents of the State of Texas who are at least 18 years of age as of the entry date. Employees of Sponsor and their respective subsidiaries, affiliates and advertising/promotional agencies involved with this promotion, including the immediate families and household members of such employees, are not eligible to enter or win. Void where prohibited by law and subject to all applicable laws.
- RELEASE:
By entering the Sweepstakes, entrant agrees to these Official Rules and to be bound by the decisions of the Sponsor. In addition, by entering the Sweepstakes, each entrant agrees to release, defend, hold harmless and indemnify Sponsor and its respective parents, subsidiaries, affiliates, contractors, directors, officers, employees and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of any injuries, losses, or damages of any kind arising out of the Sweepstakes and/or caused by the acceptance, possession, use or misuse of a prize awarded in the Sweepstakes, including but not limited to any claims for damage to property, personal injury, death or claims based on defamation, rights of privacy, rights of publicity or merchandise delivery.
Sponsor shall not be liable to any winner (or any person acting or claiming on behalf of a winner) for failure to supply a prize or any part thereof, for any reason out of Sponsor’s reasonable control, including without limitation, any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, game cancellation, insurrection or riot.
Entrants participate in the Sweepstakes at their own risk. Sponsor shall not be liable to any entrant for damages arising out of (i) any printing or typographical errors in these Official Rules or any other materials associated with the Sweepstakes or (ii) any errors in the administration of the Sweepstakes, including, without limitation, the processing of entries. Sponsor is not responsible for and shall not be liable for any condition caused by events beyond its control that may cause the Sweepstakes to be disrupted.
Acceptance of a prize by an entrant constitutes the grant by that entrant to Sponsor, its successors, agents and assigns a perpetual, non-revocable right to: (i) use that entrant’s name, voice and/or likeness, and (ii) take photographs and/or video of that entrant and to make originals and copies of, and to copyright and use, same, for purposes of advertising and promoting the Sweepstakes through other media outlets (television, radio, online) without further compensation, except where prohibited.
- GENERAL:
Sponsor reserves the right, in its sole discretion, to amend, change, cancel or suspend the Sweepstakes (or any portion of the Sweepstakes) at any time and for any reason and randomly award the prizes from among eligible entries received at the time of such action, should a virus, bugs, malicious tampering or other causes beyond the control of Sponsor corrupt the administration of proper execution of the Sweepstakes (as determined in Sponsor’s sole discretion).
Sponsor reserves the right, in its sole discretion, to disqualify any entrant found or suspected to be: 1) tampering with the entry process or the operation of the Sweepstakes, or 2) acting in violation of these Official Rules. Any attempt by an entrant to undermine the legitimate operation of the Sweepstakes may be in violation of criminal and civil laws, and Sponsor reserves the right to seek damages from any such entrant to the fullest extent permitted by law.
Sponsor reserves the right to amend or change the Official Rules at any time, in its sole discretion. Amendments will be posted on the Sponsor’s websites. By entering the Sweepstakes, the entrant consents to be bound by any and all amendments that may be made.
- WINNER LIST:
To obtain the name of the winner, send a self-addressed stamped envelope to Green Mountain Energy Attn:Megan Thornburg, 2745 Dallas Parkway #200, Plano, TX 75093 Requests for the winner list must be received by October 1, 2018.
- CHOICE OF LAW:
Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, even if Sponsor is notified of the possibility of same in advance, or any other damages, including attorneys’ fees, other than entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this Sweepstakes), and entrant further waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Texas, without regard to Texas’ choice of law rules. All proceedings shall take place in Harris County, Texas.
